This is the standard form of guarantee, as referred to in Clause 8 of the Terms and Conditions of Sale of Mitsubishi Electric Europe B.V, UK branch (“Mitsubishi Electric”), for the above products. Nothing in this guarantee shall be deemed to vary such Terms and Conditions of Sale which shall have priority over this guarantee.
1.1 Mitsubishi Electric warrants that for a period of 6 years from the date of delivery of the product to Customer (being the person, firm or company placing the order) the product shall:
1.1.1 conform to Mitsubishi Electric’s specification:
1.1.2 be free from defects in design, workmanship and materials
1.2 Mitsubishi Electric’s obligation under this warranty shall not apply to any product or part thereof which has been modified by Customer or any third party without Mitsubishi Electric’s prior written approval or has been improperly applied or has not been properly stored, used, maintained or repaired so as to materially affect the product or parts.
1.3 Final determination of warranty eligibility shall be made by Mitsubishi Electric. If a warranty claim is found to be invalid for any reason, Customer will be charged for services performed and expenses incurred by Mitsubishi Electric in repairing, handling and shipping the returned item.
1.4 This warranty covers parts only, and does not extend to Customer or end user labour costs. Expendable parts, such as fuses, lamps, and other parts that are regularly replaced due to normal use are excluded from this warranty.
1.5 Any replacement or repair within the guarantee period will not extend the original period of guarantee on that item.
1.6 The provisions of this guarantee shall survive the expiration or termination of any agreement between Mitsubishi Electric and Customer.
1.7 Mitsubishi Electric will replace or repair items covered by guarantee free of charge and items not covered by guarantee at Mitsubishi Electric’s then current standard charges. Customers shall follow specific procedure laid down by Mitsubishi Electric for returned products and spare parts including returning item to our UK service centre.
1.8 The issue of an “Authorisation to Return Goods (ARG)” Number is conditional on receipt of detailed information concerning the nature of the fault as laid out in the Failure Report Sheet document. All products returned to Mitsubishi Electric must be accompanied by a properly completed ARG form. Products will not be accepted for replacement or repair under guarantee without such form and must be labelled with the ARG Number.
1.9 This warranty covers purchases directly from Mitsubishi Electric UK or through a Mitsubishi Electric UK Approved Distributor.
1.10 Mitsubishi Electric will accept and return items in other than the original packaging with the exception of items which were found to be non-working on receipt as new by Customer in which case the items will be replaced or returned after repair in ‘as new’ packaging suitable for sale.
1.11 This guarantee excludes:
1.11.1. defects or failures caused by (i) accident, (ii) mis-use, (iii) alteration or repair undertaken without Mitsubishi Electric’s express prior written consent or (iv) neglect,
1.11.2. liability for loss of use of the equipment and/or damage to goodwill,
1.11.3. any liability in contract, tort (including negligence or breach of statutory duty) or otherwise for any indirect, special or consequential loss or damage of any nature including without limitation any loss of (i) profits (ii) turnover; (iii) earnings; (iv) revenues or receipts, (v) anticipated savings, (vi) business opportunities (vii) goodwill.
In addition the guarantee excludes call out charges, transportation costs, cost of routine adjustments and installation charges. Expendable parts such as fuses or contactors that are regularly replaced due to normal use are excluded from this guarantee.
1.12 No variation to this guarantee shall be effective unless given in writing by a Director or a Divisional Manager of Mitsubishi Electric.
1.13 This guarantee is applicable within the UK only.
